Product arrived damaged after return to the seller

Hello. I sent back a package to the seller and it arrived damaged. Seller sent me some photos and it's clearly visible that the package has outer damage(water stains, huge crack). But seller didn't issued "protokół szkody spisany z kurierem". On the DPD website I see that I can't create a complain without this document. What should I do?
